Community Participation in Election Determines the Fate of East Java

NEWS UNAIR聽– The election of East Java Governor 2018 will be held on 27 June.聽This is the third regional head election for East Java using a direct election system.

Regarding the participation and supervision of the gubernatorial election later, the General Elections Commission (KPU) of East Java Province in collaboration with the Constitutional and Government Administration Study Center, Faculty of Law聽 and the Alumni Association of United States – Indonesia (Alpha-I) Scholarship Program East Java held a seminar titled “Public Participation in Achieving Success in Implementation and Supervision at East Java Gubernatorial Election in 2018 “.

Being held in Boedi Soesetijo Hall (303) Building A FH UNAIR,聽in early June, there were three speakers from each institution. They were Muhammad Arbayanto, SH, MH, (Technical Division, KPU of East Java Province), Dr.聽Radian Salman, SH, LL.M., (Senior Researcher of Constitutional and Government Administration Study Center FH UNAIR) and M. Syaiful Aris, SH, MH, LL.M., (Coordinator of Alpha-I East Java).

The seminar, led by Dri Utari, SH, LL.M., gave the first opportunity to Syaiful Aris to speak on the Role of the Society to Improve the Quality of the Regional Head Elections.聽In his presentation, Aris said that the potential problems related to the role of society are about legitimacy, high cost, corruption, potential conflicts, neutrality of apparatus, abstain vote, and dispute resolution.

“Under the Law聽Number 8 of 2015, article 157 paragraph 3. The case of disputes over vote acquisition results is examined and prosecuted by the Constitutional Court until the establishment of a special judicial body.聽Until now the judicial body does not exist, so this case is the case of Constitutional Court, “said Aris.

Aris also said that it will increase the burden of the Constitutional Court.聽So he has a proposal for the institutional design, in which the special Court is聽ad hoc under the general judicial environment and established in the province for the initial phase.聽In relation to its formation, it shall be no later than 6 months before the first phase of operation and ends 1 year after the election stage is completed.

“Regarding the judges, it may consist of career judges and聽ad hoc,”聽聽he said.

In the election process, he added, KPU did not deny the factors that influence the number of voters.聽For example, technical factors such as individuals domiciled in region A while the Identity Card in region B. It will be difficult for them to return to their area only to vote.

Nevertheless, the seminar is expected to make voters prepared and able to vote in order to determine the future of East Java for the next five years.
