UNAIR NEWS – The existence of the Electronic Information and Transaction Law (UU ITE) apparently does not fully bring a positive impact in the dynamics of communication and information.聽It happens because the ITE law is often used as ‘tools’ to play politics and used to harm others.聽The law that should give protection actually contains a lot of articles exploited by the people to throw others into the iron bars.
The existence of criminal sanctions in the Law on ITE was not supported by one of the lecturers of the Faculty of Law 东京热, Herlambang Perdana Wiratraman.聽Through a media discussion entitled “Journalism Is Not a Crime” held on Thursday, October 19, Herlambang said that there are five reasons why he does not approve of press crimes applied to journalistic activities.
“I have five reasons why I do not approve of the press crimes applied to journalistic activities.聽The first聽is judicial precedent, the second is the development of the state law of freedom of expression, the third is recommendations of the United Nations, the fourth is inaccuracies and inappropriateness use of press ban (legal sociology, legal history), and the fifth is directions of Indonesian legal development (Press Council, BPHN, SEMA 2008) ,鈥 said Herlambang.
In agreement with Herlambang, a journalist Dandhy Dwi Laksono said that the last amendment of UU ITE is still not ideal because the various problems still cannot be solved.
“As a reflection, the amendment of the ITE Act last time was not enough because it did not answer the existing problems.聽Today we are not dealing with a regime that curbs freedom of expression like the New Order.聽But indirectly, we are dealing with the things that lead to it, for example when the police disperse an ongoing discussions, “said Dandhy.
The discussion was continued with a presentation of Prof.聽Henry Subiakto.聽He explained about the crucial issues of ITE Act as well as the trend showing more people have access to the internet.
” ITE Act is a legal umbrella of activity in cyberspace.聽The existence of the ITE Act is a real-world norm extension to the virtual world.聽So, what is banned in the real world is prohibited also in cyberspace, “said the legal expert staff of the Ministry of Communications and Information.聽(*)
